Creator Agreement

This Creator Agreement governs your relationship with FCL when you list paid or subscription spots on the Fishing Codex web marketplace at fishingcodex.com. It applies in addition to the general Terms of Service.
Key fact: as a creator on Fishing Codex, you are the merchant of record for your own sales. Buyers pay you directly via your connected Stripe Standard account. FCL charges a 15% application fee deducted at the moment of each Stripe charge. Stripe handles your KYC, tax reporting obligations, and direct payouts to your bank. FCL does not hold buyer funds on your behalf.
1. Eligibility
- You must be at least 18 years old.
- You must reside in a country supported by Stripe Connect for receiving payouts. Creator eligibility follows the current Stripe Connect supported-countries list; our onboarding flow will tell you if your country is supported.
- You must not be on any NZ, AU, US, EU or UN sanctions list, and not be located in a country subject to a comprehensive trade embargo.
- You must have a valid government-issued ID acceptable to Stripe for KYC verification.
2. Stripe Standard account requirement
To receive payments from buyers and appear on the web marketplace, you must connect a Stripe Standard account via our onboarding flow. This connection makes you the merchant of record for your own sales.
- Onboarding and KYC data collection take place on Stripe-hosted pages. FCL never sees your full bank account number or full government ID.
- FCL receives from Stripe only: your Connect account identifier, verification status, charges-enabled/payouts-enabled flags, and payout summary data.
- You separately agree to the Stripe Connected Account Agreement and the Stripe Services Agreement when you complete onboarding.
- Stripe processes each buyer payment as a direct charge on your connected account. FCL is the platform operator and collects a 15% application fee at the time of each charge.
3. KYC information Stripe will require
- Legal name (as on your ID), date of birth, residential address.
- Tax identifier for your country (for example, an NZ IRD number, AU ABN or TFN, US TIN, or the equivalent identifier Stripe requests in your jurisdiction).
- Bank account in your name, denominated in your local currency.
- Identity document (passport, NZ driver licence, or other Stripe-accepted ID).
- Business information if you are operating as a company or sole trader.
Providing false or misleading KYC information to Stripe is grounds for immediate account termination by FCL and Stripe and may be reported to relevant authorities.
4. Platform fee
FCL charges a 15% application fee on the gross amount of each web marketplace transaction, deducted by Stripe at the time of charge and remitted to FCL's platform account. You receive the remainder net of FCL's fee and Stripe's standard processing fee.

Your Creator dashboard shows the estimated net payout for any listing before you publish. FCL will give at least 30 days' notice of any change to the platform fee rate. A fee change affects new transactions only.
5. Payouts
Payouts from your connected Stripe Standard account to your bank are managed directly by Stripe according to your configured payout schedule (standard Stripe payout timing applies, typically 2–7 business days after a charge clears). FCL does not control payout timing once Stripe has received the funds.
Chargebacks and refunds. If a buyer successfully disputes a charge, Stripe reverses the charge from your connected account. If the reversal occurs after funds have already been paid out to your bank, Stripe may debit a future payout to recover the disputed amount. You agree to allow such recovery.
6. What you can list
6.1 Product types
- Free spots: listed at $0; no platform fee; contributes to your creator reputation.
- One-off paid spots: buyer pays once for lifetime access at your set price.
- Per-creator subscriptions: recurring access (monthly, annual, or lifetime) at your set price, billed via Stripe.
6.2 Photo provenance
Only photos taken inside the Fishing Codex in-app camera, with valid embedded GPS and timestamp metadata, are eligible for marketplace listings. Stock photos, AI-generated images, library-imported photos, and photos from a different location are prohibited.
6.3 Honest descriptions
Listing descriptions must be accurate and not misleading. Do not use absolute-outcome language (“guaranteed catch”). Listings must reflect your genuine personal experience at the spot.
6.4 Prohibited locations
You must not list any spot inside a marine reserve, marine protected area, no-take zone, or any area where recreational fishing is prohibited by law. If a listed spot subsequently becomes prohibited, you must promptly remove it.
6.5 No reselling others' spots
You must not list a spot you did not personally discover and capture. Spots you bought, subscribed to, or unlocked from another creator are never re-listable.
7. Tax responsibility
Because you are the merchant of record for your own sales, you are solely responsible for all tax obligations arising from your Fishing Codex earnings, including income tax, GST/VAT or sales tax, and any other local, state or national tax obligation that applies to your earnings in your country.
Stripe provides tax reporting tools and payout summaries in your Stripe dashboard. FCL retains creator-payout records for 7 years for NZ IRD compliance. FCL does not withhold income tax on your behalf and does not provide tax advice.
8. Content moderation & suspension
FCL may remove or hide listings, photos or comments without prior notice if we reasonably believe they violate this Agreement or applicable law. We will notify you of removals where legally possible.
9. 90-day lockdown rules
For 90 days after public app release, each imported spot triggers a 500 metre lockdown radius that blocks other users (creators included) from listing inside it. Once a lockdown expires, new listings are permitted only if the photo was captured through the in-app camera after the lockdown ended.
10. Reviews & badges
Reviews are available to buyers and active subscribers. They are public and contribute to your creator reputation score.

11. Account suspension & appeals
We may suspend your creator account with or without notice for material breach, fraud, false KYC, listing in prohibited areas, or legal/safety risk. For minor first-time issues we will normally issue a warning first. To appeal, email hello@fishingcodex.com with subject “Creator appeal” — we aim to respond within 10 business days.
Existing buyers and subscribers keep access to your content until the end of their current paid period regardless of suspension or self-closure.
12. Termination
To close your creator account, email hello@fishingcodex.com with subject “Close creator account”. On closure: existing buyers' and subscribers' access is honoured to the end of their current paid period; any pending Stripe balance is paid out by Stripe on your payout schedule; an archive record is retained for 7 years under NZ IRD rules; your spots, photos, profile and other personal data are deleted.
13. Changes & contact
We may update this Creator Agreement at any time. For material changes (including fee changes) we will give at least 30 days' advance notice via the creator dashboard and your account email. Continued listing of new products after the effective date is acceptance.
